You have the right to:

  • Correct your health and claims records
  • Request confidential communication
  • Ask us to limit the information we share
  • Get a list of those with whom we've shared your information
  • Get a copy of this privacy notice
  • Choose someone to act for you
  • File a complaint if you believe your privacy rights have been violated

YOUR CHOICES

You have the right to tell us your preferences regarding the following:

  • Sharing information with family, close friends, or others involved in your care
  • Sharing information in a disaster relief situation
  • Marketing purposes
  • Sale of your information

OUR USES AND DISCLOSURES

How we typically use or share your health information:

We use and share your health information to:

  • Treat you — We can use your health information and share it with other professionals who are treating you.
  • Run our organization — We can use and share your health information to operate our practice, improve your care, and contact you when necessary.
  • Bill for your services — We can use and share your health information to bill and receive payment from health plans or other entities.

How else we may use or share your health information:

We are allowed or required to share your information in other ways, usually in ways that contribute to the public good, such as public health and research. We must meet many conditions before we can share your information for these purposes. These include:

  • Help with public health and safety issues
  • Comply with law enforcement and legal proceedings
  • Respond to organ and tissue donation requests
  • Work with a medical examiner or funeral director
  • Address workers' compensation, law enforcement, and other government requests
  • Respond to lawsuits and legal actions

SPECIAL PROTECTIONS FOR SUBSTANCE USE DISORDER RECORDS

California Treatment Center provides substance use disorder treatment services. Federal law (42 CFR Part 2) provides special protections for records related to substance use disorder treatment. We will not disclose records identifying a patient as having or receiving treatment for a substance use disorder without:

  • Your written consent, OR
  • A court order, OR
  • A medical emergency, OR
  • As otherwise permitted by 42 CFR Part 2

These protections apply in addition to, and are generally more restrictive than, HIPAA protections.

YOUR RIGHTS UNDER CALIFORNIA LAW

As a California patient, you have additional rights under the California Confidentiality of Medical Information Act (CMIA) and other California laws, including:

  • The right to access your records within 5 business days of request
  • The right to receive a copy of your records at no charge in certain circumstances
  • The right to have your records amended if you believe they are inaccurate
  • The right to file a complaint with the California Medical Board or the California Department of Public Health

OUR RESPONSIBILITIES

California Treatment Center is required to:

  • Maintain the privacy and security of your protected health information
  • Notify you promptly if a breach occurs that may have compromised the privacy or security of your information
  • Follow the duties and privacy practices described in this notice
  • Not use or share your information other than as described here unless you tell us we can in writing

CHANGES TO THE TERMS OF THIS NOTICE

We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our office, and on our website at californiatreatmentcenter.org.
